It has always been thought that a Construction Manager needs to be licensed on public works. However, in a recent case, The Fifth Day, LLC, v. James P. Bolotin, held that this may not be the case. The Court of Appeal reversed the judgment that was entered by the Los Angeles Superior Court. This ruling, which was not a unanimous decision, may be considered factually specific. There was one very strong dissenting opinion.

To further protect children from exposure to lead-based paint, the U.S. Environmental Protection Agency (EPA) has issued new rules for contractors who renovate or repair housing, child-care facilities or schools built before 1978.  Under the new rules, workers must follow lead-safe work practice standards to reduce potential exposure to dangerous levels of lead during renovation and repair activities.

State Budget

Windscape LLC (“Windscape”), a developer, contracted with Western Products Co. (“Western”) wherein Western would install windows for an apartment complex.  Construction of the apartments ended in 1991. 

Windscape agreed to sell the apartments to Pine Terrace Apartments LP (“Pine Terrace”).  In May 2003, escrow on the sale closed.

BUDGET RECAP

Judge orders fines and restitution for victims

SACRAMENTO -The Contractors State License Board (CSLB) and California Attorney General Edmund G. Brown Jr. announced the settlement of a lawsuit today that will force SRVS Charge Inc. (SRVS) to pay $3 million in penalties and restitution.

This is the largest enforcement judgment in CSLB’s 80-year history.

The California Department of Industrial Relations has created a digital "Public Works Toolkit" to assist contractors and public agencies with the How To's of Public Works.
 
It is easy to use and answers many frequently asked questions.
