Q: You are helping us with obtaining a new California contractor’s license for our Limited Liability Company (LLC). We have several Members of the LLC, including myself, who plan to travel to CA to get fingerprinted. Do we all need to go to the same location to be printed?

A: No, you each can go to any live scan facility in the State of CA. The fingerprint technician will instruct you to mail the live scan form to the CSLB, but if you do the prints via live scan in CA, they are sent electronically. Therefore, no need to mail anything, but please email the forms so that I can make sure you’ve completed the requirement.

Q: We have a General Building  (“B”) CA contractor’s license for our corporation, and I am the Qualifier. I have two partners who are listed as Officers on the license/corporation. I am wanting to part ways with them and get my own corporation licensed. Isn’t it correct I get to retain the license and can transfer it to my own corporation?

A: You do keep your qualification, however a corporation license cannot be transferred to another corporation. When you are the Responsible Managing Officer (RMO)/Responsible Managing Employee (RME) on a company license and you leave the company, the license stays with the company. They are required to replace you within 90 days of your disassociation. You will be required to obtain a new license number for your corporation, but you will not have to take any exams or fingerprint again.

Q: I have had a “B” (General Building) license in CA for about 15 years. Is there a way to add specialty classifications to my license without having to take the specific Trade exams? For example, the “C-33”(Painting) classification?

A: B&P Code Section 7065.3 allows for licensed contractors to request a Waiver of the Trade exam if you have held a classification which is closely related to the trade you are adding for at least five out of the last seven years. You must also document the classification you are adding is a significant part of the work you do with your existing license.

However, the Waiver is a request, so not guaranteed, but if you can document the specific painting projects you’ve performed and supervised over a five-year period, I believe you would have a good chance of being able to waive the “C-33” exam.
