Q: Our company recently re-structured and as part of the changes, both our qualifying individual and the only officer we had listed on our listed both left the company simultaneously. Therefore, we need to replace our Qualifier and update the CSLB with the new Officer. Can you tell me if there is any order to how we should submit for these updates, or are we able to submit both the new RME and new Officer applications at the same time?
A: The first step would be update the CA Secretary of State records with the new Officer(s). You can file both the new Qualifier and new Officer(s) applications at the same time, BUT if the new Qualifier is an RME (Responsible Managing Employee), the CSLB will not accept the application until an Officer has been added to the license and the new Officer added has signed the new RME application. That means the new Officer will need to submit a new personnel application, get fingerprinted and pass the background check before the CSLB will process the RME application. When you submit the new Qualifier application, you may want to request a 90-day extension for replacing the Qualifier in case the updates take longer then 90 days which is highly likely.
Q: We received our contractor’s license renewal in the mail and it appears there are many individual signatures that we need to obtain. The Personnel list on the renewal shows the two RME’s and then eight different corporate Officers, two of which are no longer with the company. Do I need to have all of them sign? If so, what a headache, they are all over the place!
A: The CSLB requires all Qualifying individuals to sign the renewal application, and then you’ll just need to obtain the signature of one of the corporate Officers. You should probably disassociate the two Officers who are no longer with the company at the same time you send in your renewal. Any current Officer can also sign to dissociate the other Officers. Disassociation notice forms are available on the CSLB’s website or contact my office if you need any assistance with paperwork filing.
Q: Hope you are well. My colleague and I were discussing test taking in the state of Nevada. We heard that you may need to have an employee who is a resident in Nevada to take any of the building license and trades exams. Can you confirm?
A: Hope you are doing well in this new year also. Your Qualifying Individual does not need to be a resident of NV in order to qualify and take the exams. The exams are administered by PSI and they have locations throughout the Country.
